R v. SES: [Court of Justice – Killam – July 2026]
SUMMARY: This was an equally tragic/sad case involving a two-vehicle collision that resulted in the death of a nine-year-old girl and significant injuries to four other members of her family. The theory of the prosecution was that on March 28, 2025 a southbound truck driven by SES on Highway 36 was speeding and disregarded the stop sign at the intersection and proceeded to strike a westbound truck.
As a consequence of the foregoing, the RCMP conducted a lengthy in-depth investigation that resulted in the arrest of SES approximately 1 year later. SES, an elderly man with no prior convictions whatsoever, was facing the following charges:
- Dangerous driving causing death.
- Four Counts of dangerous driving causing bodily harm.
Patrick Fagan conducted an in-depth inquiry of his own into the dynamics associated with the collision and discovered (with the assistance of an expert accident reconstructionist) that arguably…the intersection in question was inherently dangerous. Further inquiries conducted by Patrick Fagan revealed that local residents had expressed concern about the dangerous nature of that intersection over an extended period of time and the local Municipality had conveyed their concerns to the Government of Alberta.
Bottom Line: This most serious criminal prosecution was ultimately resolved by way of a guilty plea to dangerous driving simplicitor (ie.: no causing death or bodily harm) with a $1,000.00 fine, 3 years’ probation and a 3 year driving prohibition.
All other criminal charges involving death and bodily harm were completely withdrawn.
