21. Regina v. R.J. [Provincial Court of Alberta, Calgary – October, 2010]

Client charged with possession of cocaine for the purpose of trafficking (approximately 1 pound) and proceeds of crime as a result of surveillance conducted by members of the Calgary Police Service. The resulting arrest and search of our client’s vehicle were challenged on constitutional grounds and on day 1 of the preliminary inquiry the agent for the Federal Department of Justice conceded the strength of our position. The bottom line . . . all charges against our client were completely withdrawn at the preliminary inquiry and the seized funds recovered.
