R v. LAK [Court of Justice, Calgary – November 2023]

SUMMARY: This was a major investigation involving the Royal Canadian Mounted Police (“RCMP”), Calgary Police Service (“CPS”), the Calgary Federal Serious and Organized Crime Team (“CFSOCT”) and the Canada Revenue Agency (“CRA”) that extended over the course of 4 years. The investigation initially focused on alleged gang-related criminal/drug activity.

Patrick Fagan closely monitored the ongoing status of the investigation and, following numerous Court appearances germane to Section 490 Criminal Code Detention/Extension Orders…was successful in staving off charges under the Criminal Code or Controlled Drugs and Substances Act.

Unfortunately for LAK, the results of the investigation conducted to that point (which included tens of thousands of documents) were turned over to the Enforcement Branch of the Canada Revenue Agency (“CRA”) for further investigation. In late 2022, LAK was charged with multiple offences under the Canada Revenue Act alleging major frauds over an extended period of time.

BOTTOM LINE: After 4 years of representing LAK, Mr. Fagan was ultimately successful in having all charges completely withdrawn.
