Clients (brothers) charged with possession of cocaine (approximately two kilograms) for the purpose of trafficking and proceeds of crime (approximately $40,000.00 cash) as a consequence of police search of their motor vehicle. As a consequence of cross-examination of the police by the defence at the preliminary inquiry it was determined that certain officers were less than forthcoming (to put it delicately) in their sworn testimonies concerning the actual facts surrounding the search and seizure. As a consequence of the foregoing the entire prosecution was terminated by way of a Stay of Proceedings is a legal term used to refer to a direction by a Crown prosecutor or a Judge to the Clerk of the Court to terminate a criminal prosecution.
