R v. GAA: [Court of Justice, Airdrie – April 2026]

SUMMARY: GAA was the driver (the “boyfriend” aforesaid) of a vehicle when it was stopped by the police in Airdrie for dubious reasons. The subsequent search of the vehicle and its occupants resulted in the seizure of a substantial quantity of morphine, codeine and cash. As a consequence, GAA found himself charged with the following offences…

(1) Possession of Morphine for the Purpose of Trafficking

(2) Possession of Codeine for the Purpose of Trafficking

(3) Possession of Proceeds of Crime.

Patrick Fagan elected trial by way of a Justice of the Court of King’s Bench of Alberta (no jury) and scheduled a preliminary inquiry.

Bottom Line: Prior to commencement of that preliminary inquiry, Patrick  Fagan was able to convince the assigned Crown Prosecutor of the strength of his constitutional position. As a consequence, all charges against GAA were completely withdrawn.
