R v. FOC: [Court of Justice, Calgary – October 2025]

SUMMARY: FOC was the target of an investigation conducted by the CPS  Organized Crime Enforcement Team. Surveillance led the police to believe that FOC was trafficking in cocaine and they obtained Warrants to Search his home and vehicle.  

FOC was arrested while operating a motor vehicle and on his person, police found a quantity of cocaine, fentanyl and approximately $3,000.00 cash. As for his home, the police seized another 55.1 grams of cocaine. FOC was  charged with the following offences: 

(1) Possession of Fentanyl for the Purpose of Trafficking 

(2) Possession of Cocaine for the Purpose of Trafficking 

(3) Possession of Proceeds of Crime.

Bottom Line: Patrick Fagn was successful in terminating this entire prosecution by way of the entry of a Stay of Proceedings.
