R v. KKK [Court of Justice, Drumheller – November 2025]
SUMMARY: This was an exceedingly sad case involving a single vehicle rollover that resulted in the death of 2 teenage boys. As a consequence of the rollover, KKK was charged with 14 separate criminal charges including:
- 2 Counts of Operating a Motor Vehicle Over .08 Causing Death.
- 2 Counts of Dangerous Driving Causing Death.
- 10 other related driving charges resulting in bodily harm to other occupants of the vehicle.
Patrick Fagan conducted in-depth inquiries into the dynamics associated with the rollover and discovered evidence which suggested the following: (1) KKK was not responsible for the rollover, (2) impairment/over .08 did not contribute to the rollover.
KKK could have rolled the dice and taken the matter to trial but it was ultimately decided that the best route to go in all the circumstances was a negotiated plea.
Bottom Line: The entire matter was ultimately resolved by way of a guilty plea to a traffic violation (operating a motor vehicle without due care and attention contrary to the Traffic Safety Act) and operating a motor vehicle with a blood alcohol level over .08. The former charge was dealt with by way of a $500.00 fine and the latter by way of a $1,000.00 fine. The Court imposed an 18-month period of probation and a 1-year driving prohibition.
All other charges related to causing death and bodily harm were completely withdrawn.
