R v. MMH: [Court of Justice, Airdrie – January, 2026]
SUMMARY: MMH was the passenger in her boyfriend’s car when it was stopped by the police in Airdrie for dubious reasons. The subsequent search of the vehicle and its occupants resulted in the seizure of a substantial quantity of morphine, codeine and cash. Most of the drugs were seized from the centre console but (to make things a bit more challenging for MMH) a small quantity of morphine was located in her purse. As a consequence, she found herself charged with the following offence: possession of morphine contrary to Section 4(1) of the Controlled Drugs and Substances Act.
Bottom Line: Patrick Fagan was successful in having all charges against MMH completely withdrawn.
Patrick C. Fagan is a highly accomplished lawyer with an impressive career spanning over 35 years in the legal field.
