R v. HM [Court of Justice, Calgary – January 2024]
SUMMARY: HM had the misfortune of being a passenger in a vehicle being driven by her alleged “gangster” significant other when it was stopped and searched by the police. When the police searched HM’s purse, they found a loaded handgun and charged her accordingly.
RESULT: A plea of not guilty was entered and a 1-week trial conducted in the Court of Justice. At the conclusion of trial proceedings Patrick Fagan was successful in having the handgun excluded from evidence resulting in the successful termination of those proceedings by way of a Stay of Proceedings.
